All content (text, pictures, etc.) published on this website is subject to German copyright laws. Private and commercial use of the content without permission is prohibited. Contributions of third parties, especially pictures, videos and texts are indicated as such. However, if you notice any violations of copyright law, please inform me immediately, so I can remove such contents.

3. Links to other websites

andysmunichtours.de includes links to external third party websites. I do not have influence on the published contents of those websites. I therefore cannot guarantee for those contents. Providers of linked websites are always responsible for their published contents.

4. Kleinunternehmerregelung i.S.d. § 19 UStG (small-scale business regulation)

According to § 19 UStG (German Value Added Tax Act) I do not charge the German value added tax, and consequently do not account it (small-scale business).

Data protection & privacy policy

I am not interested in your personal data, but as you can book a tour I will need some data from you such as your Name, Email adress, and some other things in order to contact you because of your tour request.

Also every website you visit, collects some data from you, such as your IP-adress. Therefore you should know what happens to your data and what data I (or my website provider) collects.

Privacy Policy

Personal data (usually referred to just as “data” below) will only be processed by us to the extent necessary and for the purpose of providing a functional and user-friendly website, including its contents, and the services offered there.

Per Art. 4 No. 1 of Regulation (EU) 2016/679, i.e. the General Data Protection Regulation (hereinafter referred to as the “GDPR”), “processing” refers to any operation or set of operations such as collection, recording, organization, structuring, storage, adaptation, alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or otherwise making available, alignment, or combination, restriction, erasure, or destruction performed on personal data, whether by automated means or not.

The following privacy policy is intended to inform you in particular about the type, scope, purpose, duration, and legal basis for the processing of such data either under our own control or in conjunction with others. We also inform you below about the third-party components we use to optimize our website and improve the user experience which may result in said third parties also processing data they collect and control.

II. The rights of users and data subjects

With regard to the data processing to be described in more detail below, users and data subjects have the right

– to confirmation of whether data concerning them is being processed, information about the data being processed, further information about the nature of the data processing, and copies of the data (cf. also Art. 15 GDPR);

– to correct or complete incorrect or incomplete data (cf. also Art. 16 GDPR);

– to the immediate deletion of data concerning them (cf. also Art. 17 GDPR), or, alternatively, if further processing is necessary as stipulated in Art. 17 Para. 3 GDPR, to restrict said processing per Art. 18 GDPR;

– to receive copies of the data concerning them and/or provided by them and to have the same transmitted to other providers/controllers (cf. also Art. 20 GDPR);

– to file complaints with the supervisory authority if they believe that data concerning them is being processed by the controller in breach of data protection provisions (see also Art. 77 GDPR).

In addition, the controller is obliged to inform all recipients to whom it discloses data of any such corrections, deletions, or restrictions placed on processing the same per Art. 16, 17 Para. 1, 18 GDPR. However, this obligation does not apply if such notification is impossible or involves a disproportionate effort. Nevertheless, users have a right to information about these recipients.

Likewise, under Art. 21 GDPR, users and data subjects have the right to object to the controller’s future processing of their data pursuant to Art. 6 Para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.

III. Information about the data processing

Your data processed when using our website will be deleted or blocked as soon as the purpose for its storage ceases to apply, provided the deletion of the same is not in breach of any statutory storage obligations or unless otherwise stipulated below.

Server data

For technical reasons, the following data sent by your internet browser to us or to our server provider will be collected, especially to ensure a secure and stable website: These server log files record the type and version of your browser, operating system, the website from which you came (referrer URL), the webpages on our site visited, the date and time of your visit, as well as the IP address from which you visited our site.

The data thus collected will be temporarily stored, but not in association with any other of your data.

The basis for this storage is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality, and security of our website.

The data will be deleted within no more than seven days, unless continued storage is required for evidentiary purposes. In which case, all or part of the data will be excluded from deletion until the investigation of the relevant incident is finally resolved.

Order processing

The data you submit when ordering services from us will have to be processed in order to fulfill your order. Please note that orders cannot be processed without providing this data.

The legal basis for this processing is Art. 6 Para. 1 lit. b) GDPR.

After your order has been completed, your personal data will be deleted, but only after the retention periods required by tax and commercial law.

In order to process your order, we will share your data with the payment service provider (if apllicable) to the extent required to process your payment.

The legal basis for the transfer of this data is Art. 6 Para. 1 lit. b) GDPR.

You do want to have a tour and not read terms and conditions. I understand that, but a few things you should really read, as the following terms and conditions form the basis of your contract with me (if you book a tour).

II. Revisions and Errata

All informations on this website and in my walking tours were deemed accurate when published, however, details such as opening hours, rates, transportation, and safety (non-exhaustive list) can change without notice.

III. Independence & Assurance of non-promotion

I do not like writers that do write reviews or articles about things like restaurants and hotels, but actually just put together available information. I want to give you honest and true information and recommendations. I’m therefore independent and will not publish paid reviews.

IV. Tours and excursions

a) My tours and excursions will be held according to the information provided in each tour description. Please note, that deviations are sometimes necessary and are made at my discretion. Of course you will get informed about deviations.

b) Participants will be accompanied during the whole tour or excursion by me.

c) All tours and services given are for historical and/or educational interest and/or for your personal entertainment only.

d) I do not advocate historical revisionism (particularly in regard to the Holocaust, National Socialism and Nationalism). I do also not support or otherwise endorse political or religious extremism.

e) Participants who attempt to use the locations visited or historical information given to further any racist or extreme political belief will be banned from tours and services.

f) Participants who are obviously intoxicated or under the influence of alcohol or other drugs, violate safety directives or instructions given by the tour leader, continually disrupt the tour, or present a danger to themselves or others may be banned from tours and services at my discretion. In these cases I reserve the right to deny a refund.

g) All timings of tours and services are approximate, as there are many variables to consider such as the walking pace of participants, duration of participant-demanded breaks, traffic density, public transport delays, etc..

h) All participants confirm that they are physically able to take part in a tour or excursion. They also confirm to be dressed appropriate for the specific weather conditions when participating on a tour or excursion. As the weather in Munich from November until March can be quite cold, I strongly recommend wearing winter clothes (warm boots, gloves, scarf, hat).

i) Participants in the excursion are required to practice common sense, prudence and diligence.

V. Booking and confirmation

a) All services on this website may be requested online (by contact form or e-mail) or by phone.

b) After requesting a tour or service, you will get an e-mail within 24 hours with further information (payment, tour details, meeting point, etc.). If you did not get an e-mail, please contact me directly by e-mail or phone. Please be aware that contacting me through a phone call may cause costs for you (especially international calls).

VI. Prices and payment

a) Unless otherwise stated, prices indicated are total prices (excluding 19% German value added tax – VAT which is not charged due to the small-scale business regulation; see “legal notices” No. 4). There are no additional taxes, fees or charges. What you see is what you pay.

b) after booking, an advance payment of at least 50% is necessary to confirm the booking. The payment has to be made by PayPal transfer (“PayPal.me”). The final payment consisting of the remaining balance must be transferred at least two days prior to the tour.

c) Money transfer often comes with banking or transfer fees. Be aware that your payment provider (bank, credit card company, etc.) may charge fees for sending money via PayPal. Also be aware that paying in a different currency than Euros may cause additional fees for you. Especially credit card companies often charge a “foreign currency fee”.

VII. Cancellation & refunding policy

Sometimes things go different than we expected.

a) If you cancel (you don’t have to specify why):

– More than 5 days in advance: I will give you a full refund less any banking fees. Please also note that if you paid in a currency other than Euros (€), I can only refund using the current exchange rate offered by my bank at the date of the transaction.

– Less than 5 days in advance until 24 hours before the confirmed tour date: I will give you a 50% refund less any banking fees. Please also note that if you paid in a currency other than Euros (€), I can only refund using the current exchange rate offered by my bank at the date of the transaction.

– Less than 24 hours before the confirmed tour date: No refund possible.

Please note that you always have the chance to reschedule the tour or service (prior to the fixed date and time) by contacting me.

b) If I have to cancel:

In the unlikely event that due to sickness or on account of force majeure or other unforeseeable events I am unable to provide your booked tour or service on the day and time specified, I will offer a similar or alternative tour or service exceeding the price you have already paid a deposit on. If you can’t accept the offered alternative tour or service, you will get a full refund (see VII a).

c) Being late: I will wait for you 30 minutes.

d) “No-Show”: If you do not show up within 30 minutes after the fixed appointment I reserve the right to leave. No refund can be given.

VII. Liability

Andysmunichtours (see “legal notice”) assumes no liability or responsibility for any injury, loss, damage or inconvenience sustained by any person using its services, nor to their property. All persons participating in tours, excursions and other services do this at their own risk. All persons are liably for themself.

VIII. Applicable Law/Place of Fulfillment/Court of Jurisdiction

Munich, Bavaria, Germany is the sole place of fulfilment and jurisdiction. German law is applicaple.
